To be fair at second viewing it does surpass the necessary force required so is probably a tort in assault. Ironically on the train last week their I saw a similar situation but this lady had no single ticket. Her station was passed long ago. Rather then throwing her off the train he gave her a fine, which she couldn't pay, so she was told too write her address name and number on a paper. She then blatenlty bs'd him saying she was homeless. Unlike this guy the guy stopped at the next station and took her with him. I missed the rest but if you compare the two situations it's quite a different approach. Unless the procedures are different in Scotland I can't really fathom why he didn't give him the generic fine thing. The guy who did throw him off wasn't even under duty to check tickets so he can't even construe a reasonable defense. Ultimately, he's probably screwed.
